Kerala High Court grants anticipatory bail to actor Vijay Babu, accused in the rape case MPNRC

Kochi: Malayalam filmmaker and actor Vijay Babu was granted anticipatory bail by the Kerala High Court on Wednesday in a rape case against him.

Justice Bechu Kurian Thomas granted relief to Babu on the condition that he would “surrender” before the Investigating Officer (IO) for questioning on June 27. From then onwards he can be interrogated for the next 7 days till July 3 and he will not contact or talk to the victim or any of the witnesses in the case.

Other conditions imposed on him by the court were that he “will not engage in any form of attack against the victim or his family through social media or other means”, not leave Kerala and if he has been issued a new passport, Surrender him.

The court further said that if the investigating officer wanted to arrest Babu, he would be released on bail on a surety of Rs 5 lakh and execution of two sureties of like amount.

During the period from June 27 to July 3, she will be deemed to be in police custody “to facilitate the requirements of the investigation”, the court said while allowing her plea for anticipatory bail in the rape case.

The police had opposed his plea, saying the practice of filing applications for bail sitting outside the country should not be considered.

The court did not accept this argument as it was of the view that application for pre-arrest bail can be filed by a person residing outside the country.

“However, the only limitation is that before the final hearing, the applicant must be inside the country so that the court may be able to try and enforce the conditions under the statutory provisions.”

The court had granted him interim protection from arrest on May 31 and since then it was being extended from time to time.

Babu, in his petition, had alleged that a rape case has been registered against him for blackmailing him.

He has been accused of allegedly sexually assaulting a female actor and disclosing the identity of the victim through a Facebook Live session.

The producer-actor, in his plea, had also alleged that there is a “tendency” to make sexual allegations against someone in order to gain popularity and tarnish the image of a person in the society for publicity.

Babu had claimed that he was innocent and was “extremely saddened” by the one-sided approach of the authorities to make him a “scapegoat for news and media purposes”.

The woman, who appeared in films produced by Babu’s production house, filed a police complaint on April 22 and told through a Facebook post that she was a victim of physical harassment and sexual abuse allegedly at the hands of the producer-actor for the past one year. Opposing Babu’s plea, the woman’s counsel had argued before the court that the actor-producer had allegedly “abused and abused the trust in her”.

It was also argued on her behalf that being a novice artist, her objections were easily subdued and she was allegedly sexually harassed repeatedly by him.
